On June 3, 2022, USTR issued the latest announcement, extending the exclusion validity period of 81 products that were previously extended for six months from May 31, 2022, to November 30, 2022. Details are as follows:
On December 29, 2020, U.S. time, the U.S. Trade Representative (“USTR”) announced in the Federal Register (FR) that in order to continue to effectively combat the COVID-19 epidemic, products that were currently subject to Section 301 tariffs were temporarily excluded from the tariffs. The product exclusion validity period for 80 products that have not been exempted from tax will be extended; in addition, 19 products that have not been excluded will be newly exempted and will not be taxed for the time being. The above total of 99 exclusions is valid until March 31, 2021.
On March 10, 2021, USTR issued an announcement on FR to extend the exclusion period for the above products to September 30, 2021. On September 29, 2021, USTR issued another announcement, temporarily extending the validity period of the above-mentioned product exclusions for a third time by 45 days to November 14, 2021, so that it has sufficient time to consider the comments submitted by all parties as of September 27 , to decide whether to extend the exclusion period of the above products for another 6 months.
On November 16, 2021, USTR issued an announcement on FR. Taking into account the need to fight the epidemic in the United States, including the suppression of Delta mutant viruses, for the above 99 excluded products that expire on November 14, 2021:
1. Grant a 16-day transition period, which will extend the exclusion period for the 99 products from the previous November 14, 2021, to November 30, 2021;
2. For 81 of the excluded products, the exclusion validity period will continue to be extended for 6 months, that is, until May 31, 2022.
On June 3, 2022, USTR issued the latest announcement on FR, extending the exclusion validity period of the above 81 excluded products from the original May 31, 2022, by 6 months to November 30, 2022.
As of now, the 301 taxed product exclusion list involves a total of 30 tax codes for textile and clothing products. The exclusion is valid until December 31, 2022. See the table below for details:
